Definitions & Interpretation 定義與釋義

1.1

These Terms & Conditions govern admission to and participation in the educational event, <Event Name> (the “Event”), organised by Alongside Limited (“Alongside”, “we”, “our”, “us”). These Terms & Conditions apply to all tickets, registrations, and attendance for the Event, whether or not expressly referenced on any ticket, email, webpage, or purchase confirmation. By registering for or purchasing a ticket for the Event, you agree to be bound by these Terms & Conditions and Alongside’s Privacy Policy and Personal Information Collection Statement (PICS). If you register or purchase a ticket on behalf of another person, you confirm you are authorised to do so and you agree to ensure that person is aware of and agrees to these Terms.

本條款及細則適用於由 Alongside Limited(「同行」、「我們」)主辦之教育活動「<活動名稱>」(下稱「活動」)之入場及參與。無論門票、電郵、網頁或購買確認函是否明確載有本條款及細則,所有門票、報名及出席均受本條款及細則約束。閣下一經報名或購票,即同意受本條款及細則,以及同行之私隱政策及個人資料收集聲明(PICS)約束。若閣下代表他人報名或購票,即確認已獲授權,並確保該人士知悉並同意本條款。

1.2

In these Terms and Conditions:
於本條款中:

(i) “Ticketing Platform” means the payment/registration service provider and/or ticketing platform we use; and
   「票務平台」指我們使用之付款/報名服務供應商及/或票務平台;及

(ii) “Venue” means the location of the Event (or any rescheduled location).
   「場地」指活動舉行地點(或任何改期後之地點)。

Headings are for convenience only and do not affect interpretation.

Non-Refund Policy 不設退款政策

2.1

All tickets are non-refundable and non-exchangeable after purchase.
所有門票一經購買,恕不退款或更換

Force Majeure (includes weather signals) 不可抗力(包括天氣信號)

3.1

If the Event is prevented, delayed, terminated, or otherwise affected by circumstances beyond Alongside’s reasonable control (each a “Force Majeure Event”), the Event will be cancelled with no refund.
如活動因超出同行合理控制範圍之情況(下稱「不可抗力事件」)而受阻、延誤、終止或受影響,活動將取消且不設退款。

3.2

Force Majeure Events include, without limitation:
不可抗力事件包括但不限於:

  1. Typhoon Signal No. 8 or above, Black Rainstorm Warning, or “Extreme Condition” hoisted or announced by the HKSAR Government before or during the Event;
    於活動前或期間懸掛八號或以上颱風信號、黑色暴雨警告或政府公布「極端情況」;
  2. any law, regulation, restriction, prohibition, order, notice, guideline, licence or permit issue, or direction of any government, authority or court that prevents or materially impairs the Event;
    任何政府、主管機關或法院之法律、規例、限制、禁令、命令、通告、指引、牌照或許可問題、或指示,致使活動無法或大受影響而進行;
  3. public-health events and safety measures: epidemic, pandemic, quarantine or isolation requirements, or venue/building safety incidents;
    公共衞生及安全:流行病、疫症、檢疫或隔離要求、或場地/樓宇安全事故;
  4. venue or building issues: fire, explosion, flooding, structural or mechanical failure, evacuation, power failure or other building emergencies;
    場地或樓宇問題:火警、爆炸、水浸、結構或機械故障、疏散、停電或其他緊急事故;
  5. industrial and infrastructure disruption: strikes, lockouts, labour disputes, transport disruption, or utility outages (power, water, telecoms);
    產業及基建中斷:罷工、停工、勞資糾紛、交通受阻或公用設施中斷(電力、食水、電訊);
  6. acts of god or natural events: earthquake, storm, typhoon, landslide, flood, or other natural disaster;
    天災或自然事件:地震、風暴、颱風、山泥傾瀉、水災或其他天然災害;
  7. illness, injury, bereavement or other emergencies affecting speakers or essential personnel, including where a suitable substitute cannot reasonably be arranged in time; and
    影響講者或重要人手之疾病、受傷、喪親或其他緊急情況,包括在合理時間內無法安排合適代替者;及
  8. any comparable or unforeseen event beyond our reasonable control, whether similar or dissimilar to the above.
    任何其他超出我們合理控制、性質相若或不相若之不可預見事件。

3.3

If a Force Majeure Event takes place, we may, at our sole discretion, offer a rescheduled session and either carry over existing tickets or allow an exchange of tickets to a designated session of equivalent nature, in each case subject to availability and any procedures or deadlines it specifies. If the Event is not rescheduled, no further compensation will be provided. We are not liable for any costs or losses (e.g., travel, accommodation) arising from a Force Majeure Event.
如有不可抗力事件發生我們可按全權酌情提供改期場次,並將原有門票沿用或容許更換至性質相若之指定場次;上述安排均以名額供應及我們所訂程序/期限為準。倘未有改期安排,恕不作任何賠償。就不可抗力事件所引致之任何費用或損失(例如交通或住宿),我們概不負責。

Adverse Weather Handling 惡劣天氣安排

4.1

If Typhoon Signal No. 8 or above, Black Rainstorm Warning, or “Extreme Condition” is in force within two (2) hours before the scheduled start time, the Event will be cancelled and handled under Clause 3. If such signals are issued during the Event, the Event will be terminated and handled under Clause 3.
如於活動預定開始前兩小時內懸掛八號或以上颱風信號、黑色暴雨警告或公布「極端情況」,活動將取消並按第3條處理;如於活動期間發出相關信號,活動將即時終止並按第3條處理。

Compliance with Laws & Venue Rules 法規及場地規則

5.1

You must observe all applicable laws and regulations, and comply with all reasonable rules, instructions, and requirements imposed by Alongside or the Venue. We may refuse admission or require any person to leave for non-compliance, safety, disruption, misconduct, intoxication, or harassment. No refund will be provided in such cases.
閣下須遵守一切適用法律及規例,並遵從同行或場地所合理施加之規則、指示及要求(包括健康、安全、保安及場地守則)。如有不遵守、影響安全、擾亂秩序、不當行為、醉酒或騷擾等情況,我們可拒絕入場或請其離場;在此等情況下恕不退款。

Accessibility & Special Arrangements 無障礙及特別安排

6.1

We aim to make the Event accessible. Please tell us at registration if you require special arrangements (for example: step-free routes, or other reasonable adjustments). We will use reasonable efforts to coordinate with the Venue to facilitate such arrangements; however, availability is not guaranteed and may be limited by Venue facilities, safety, capacity, or supplier constraints. Where an arrangement cannot be provided, your ticket remains subject to these Terms (including the non-refund policy). At our discretion, we may offer an exchange or carry-over to a later event if possible.
我們致力提升活動的可及性。若閣下需要特別安排(例如無台階通道或其他合理調適),請於報名時提出。我們將盡合理努力與場地協調以促成相關安排;惟實際提供與否不保證,並可能受場地設施、安全、容量或供應商限制。如未能提供相關安排,門票仍受本條款(包括不設退款政策)所約束。倘若許可,我們可按酌情權提供更換場次或順延至其後的活動。

Photography and Recording 攝影及錄影

7.1

By attending, you consent to Alongside using photos/videos of the Event for documentation, educational, and promotional purposes. If you object, please email us in advance.
閣下出席活動即表示同意 Alongside 於紀錄、教育及宣傳用途使用活動照片或影片。若有異議,請預先電郵通知。

Updates to Privacy Policy Statement 私隱政策聲明之更新

8.1

We collect and use your personal data for registration, ticketing, event administration, safety notices, and necessary communications. Data may be disclosed to and/or processed by third-party providers (including but not limited to the Ticketing Platform) solely for these purposes and in accordance with their privacy policies.
我們就報名、票務、活動行政、安全通知及必要聯絡而收集及使用閣下之個人資料;相關資料或會提供予和/或由第三方服務供應商(包括但不限於票務平台)僅為上述目的而處理,並受其私隱政策所規管。

Programme Changes 節目更改

9.1

Content, schedule, format and delivery method may change without prior notice. We may, at our discretion, substitute speakers, adjust timing, or switch to online or hybrid delivery where reasonably necessary. 
內容、時間、形式及舉行方式或不經事先通知而變更;在有需要時,我們有酌情權可替換講者、調整時間,或改為網上/混合形式。

Liability 責任

10.1

Except for liability that cannot be excluded under law, we are not liable for any loss, injury, or damage arising from attendance at the Event, save where directly caused by Alongside’s negligence. To the extent permitted by law, our aggregate liability to you in connection with the Event is limited to the amount of the ticket price you paid.
除法律不可排除者外,除非因同行之疏忽直接造成,否則對於因出席活動而引致之任何損失、傷害或損害,我們概不承擔責任。在法律許可範圍內,我們就活動所承擔予閣下之累計責任以上述門票已付金額為上限。

Governing Law管轄法律

11.1

These Terms are governed by the laws of the Hong Kong SAR. The courts of the Hong Kong SAR have non-exclusive jurisdiction.
本條款受香港特別行政區法律管轄;香港特別行政區法院享有非專屬司法管轄權。
